DRAFT FAMILY COURT JUDGES (RECRUITMENT) RULES
1. Short Title and Commencement :-
(1) These rules may be called the .........................
(Name of the State Family Court Judges (Recruitment) Rules, 1999)
(2) They shall come into force at once.
2. Method of Recruitment and Qualifications for Recruitment of Judges of Family Courts :- Recruitment of Judges of Family Courts shall be made either ,-
(a) by transfer or deputation of a person who is in the service of the Union or of the State and who has for atleast seven years,-
i) held a judicial office in India; or
ii) held an office of a Member of Tribunal or any post under the Union or State requiring special knowledge of law; or
(b) by direct recruitment of a person who has for at least seven years been an Advocate of a High Court or two or more of such courts in succession; selection being made by the High Court under and in accordance with the rules governing the direct recruitment of District Judges of the Judicial service of the State. The persons so recruited shall be on probation for a period of two years and their age of superannuation shall be 62 years. For removal of doubts it is hereby clarified that there shall be no tenure appointment of persons so recruited.
3. Conditions of Service :- The conditions of service of District Judges of the State Judicial Service shall proprio-vigore apply to the Family Court Judges.
